Terms and Conditions

Wedding Contract and Agreement


ENTIRE AGREEMENT: This agreement contains the entire understanding between HEARTS IN MOTION and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties or through confirmation via email, text message, or messenger apps. If the parties want to waive one provision of this agreement that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing. Client understands that HEARTS IN MOTION is a TEAM of professional wedding filmmakers. The Team is honed in the industry together for years to achieve HEARTS IN MOTION’s certain style and standards.


  • RESERVATION: A signed contract and reservation fee are required to reserve and block the wedding date.


  • COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. HEARTS IN MOTION is not responsible if a key individual fails to appear or cooperate during photography/videography sessions or for missed shots due to details not revealed to HEARTS IN MOTION. The team recommends that CLIENT designate an “event guide/ shot-list” to point out important individual/details for informal or candid shots to the team during the wedding that they wish to have captured.


  • HOUSE RULES: HEARTS IN MOTION team is limited by the guidelines of ceremony official and reception site management. The CLIENT agrees to accept the technical results of their imposition on the team (eg.sound system, off limit areas). Negotiation with the officials (church, venue) for moderation of guidelines is CLIENT’s responsibility; HEARTS IN MOTION will offer technical recommendations only. Additional miscellaneous fees (eg.church electricity, hotel electricity, bill will be shouldered by client.)


  • EXCLUSIVITY: It is understood and agreed that no other professional videographer will be allowed to take videos at the wedding while the TEAM is working. Should any guest/supplier is obstructing or blocking the videographer’s view during the shoot, HEARTS IN MOTION has the right to ask the guest/supplier to clear the point of view. It is beyond HEARTS IN MOTION’s control in any case of obstructions during recording.


  • START / STOP TIMES: The team will arrive at the preparation venue five (6) hours before the ceremony time; this indicates the start of the service. It ends as soon as the ‘’Thank You Speech” by the couple or host has been made; additional overtime payment (eg. Afterparty) will be required once exceeded.


  • WEDDING VIDEO OUTPUT: HEARTS IN MOTION will strive it’s best to give the couple the best videos they can based on the team’s style and standard, however, the CLIENT fully understands that the outcome and output of the videos will depend on the contents and what will happen on the wedding day itself. (Eg, PROPER COORDINATION, reaction of the couple and the guests, weather condition, ambient light availability, promptness of the entourage, details of the wedding, time given to the videographers, relatives requests, traffi­c situation, make-up style, decision of the couple, etc).



    OUT OF TOWN FEE – are expenses that cover the transportation and accomodation expenses. This includes gas fee, service vechicle to be used on the location, accommodation, travel time, days of stay on the location, food, risk and safety of the team and possible booking for the dates that will be affected. If HEARTS IN MOTION team is required by the client to be on the location days before the wedding, for convenience and safety, the client must provide shelter and food. Out of town fee for wedding is different from out of town fee in prenup/prewedding.


  • FOOD: In a fast paced event, we always arrive 6 hours before the wedding ceremony in order for us to capture a lot of details, candid moments, and shots of the couple. We do get tired and we need nourishment to keep our strength and stamina. With that, the CLIENT will be responsible in shouldering meals for the team – Breakfast & Lunch for Morning Weddings; Breakfast, Lunch & Dinner for Afternoon Weddings. In any case that the client cannot prepare or fail to prepare meals, 300php will be charged, per person, per meal.


  • QUANTITY OF VIDEOS TAKEN AND TAKING OF SIMILAR FOOTAGES: Videographers’ mistakes are not hidden from the couple. All RAW footages are given to them (couple will provide SSD or Hard Drive), any exposure, framing, focusing mistakes, accidental recording is also seen and received. This occurrence, though not wanted by the videographer, is guaranteed to occur due to statistics of mechanical, human and situational errors that cannot be overcome. The couple should also realize that up to 1/5 of the shot taken could be very similar by using this system to ensure that a good shot is recorded. Client should understand that RAW videos are unfinished products.



  • STORAGE: All raw/unedited videos from the wedding will be ready right after the wedding reception; CLIENT must provide external HDD or SSD for storage with at least 300GB of FREE space. If the CLIENT fails to bring the storage on the wedding day, HEARTS IN MOTION is no longer liable if the fi­les have been lost, stolen, corrupt or destroyed for reasons beyond HEARTS IN MOTION’s control. Should the Client fails to copy their files on the wedding day or lost their files and wishes to recopy again, given that the files are still available; there will be a storage fee of 4,000php (7) Days Grace Peroid after the wedding. Once all the files (Edited or Unedited) have been copied, given that the all the edited videos have been delivered, HEARTS IN MOTION is no longer responsible in keeping the clients’ files.

    The copies of fi­les HEARTS IN MOTION will give at least seven (7) days grace period after all the outputs have been delivered; HEARTS IN MOTION will DELETE all the raw fi­les after that


  • COPYRIGHT: Until final payment for services rendered is made, all videos produced by HEARTS IN MOTION are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner without HEARTS IN MOTION explicitly written permission. Edited videos or uploaded videos through social medias may be used as long as a copyright notice appears stating that they were taken by HEARTS IN MOTION and also the team’s Facebook page or Instagram account should be tagged.


  • PROMOTIONAL USE: The CLIENT hereby grants HEARTS IN MOTION and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish videos of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising, blog, magazines and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases HEARTS IN MOTION and its legal representatives and assigns from all claims and liability relating to said videos.


  • PUBLICITY RIGHTS: The team has the freewill to choose whether to post or not to post the videos in our social media pages. This does not mean that the wedding is less beautiful or valuable. Since we have a certain aesthetic and standard that we are drawn to, a lot of factors are considered for selecting material (e.g. wedding style, location, color palette, mood, elements, details, lighting availability etc.).


  • CHANGE OF DATES: Another reservation fee of Php 5,000 will be charged should the Client wishes to change dates, given that the team is still available on the given date. Upon signing of this agreement by both parties hereto, HEARTS IN MOTION will reserve the time agreed upon and will make reservation for the specific time frame. For this reason, all deposits are non-refundable and non-transferable even if the date is changed or if the wedding is cancelled for any reasons. Cancellation of wedding can be acknowledged via EMAIL or messenger apps.


  • DELIVERABLES AND TURN AROUND TIME: The team’s style on editing is uniquely standard. We aim to provide an elegant and modern look by avoiding styles of traditional videos. Final output of the Cinematic Highlights or Full Wedding Video timeline is approximately (4) to six (6) months after the wedding day or even longer. This is why we give a copy of the Same Day Edit video within the day of the wedding as we want the Client to have something immediate to share with friends and family while waiting for the other outputs. It’s important we do not rush the creative process. There is an art involved. This philosophy leads us to long excruciating hours, days and weeks of editing the video. RUSH SERVICES & COST APPLY. If a rush situation does arise, HEARTS IN MOTION will make every reasonable effort to accommodate client’s needs. In this case, client will be billed for rush charges on the final payment.



  • SHIPPING OF PRODUCTS: The client is responsible for all shipping arrangements and online transfer costs of product(s) to and from HEARTS IN MOTION. HEARTS IN MOTION will not be held responsible in any way for products damaged or lost during the shipping process.


  • SAME DAY EDIT VIDEO: All footages on the Same Day Edit Video will be an artist’s choice. The client agrees that any video taken during the wedding day may or may not be shown during the presentation of the Same Day Edit Video. HEARTS IN MOTION will not provide any laptop, cable, projector, etc. to make the showing of Same Day Edit possible. For HEARTS IN MOTION Signature Same Day Edit Video, CLIENT understands that the Same Day Edit Video can only be played before or after the ending speech during the Reception. Client also understands that HEARTS IN MOTION will not be liable in case of failure in the System of the Supplier’s Screen or Sound System during the playback.


  • PRENUP/PREWEDDING SESSION: Client must shoulder other expenses needed on the day of the shoot. Food and drinks will be shouldered by the client – Breakfast, Lunch and Dinner will also be shouldered by the client if the team is still shooting from 6pm onwards. PRENUP/PREWEDDING session will have a maximum of 4 different sets [provided by the CLIENT or stylist] additional P5,000 for another set, additional 15,000 for additional day. The client agrees that the date of PRENUP/PREWEDDING is tentative and can be changed by HEARTS IN MOTION if a wedding booking on that date takes place. Client should have their Prenup/Prewedding session at least a month before the wedding. In any event that the client decided to have their PRENUP/PREWEDDING shoot week/weeks before the wedding, HEARTS IN MOTION has the right to apply rush fee of Php 5,000.



  • FORCE MAJEURE: In the event of Force Majeure (declaration of Martial law, pandemic, war, strong typhoon, flood, volcanic eruption), where our team’s safety will be put at great risk, HEARTS IN MOTION reserves the right to cancel the service to the client. In any case, HEARTS IN MOTION team will still strive their best to make it happen.



  • PAYMENTS: CLIENT agrees to timely payment. A down payment is deposited herewith to reserve event coverage for the service coverage specified above. Reservation fee is deductible to the total chosen package. All payments made are non-refundable/non-transferable. HEARTS IN MOTION has the right to hold the videos and other files if payment terms are not followed and until final payment is not made.
